Terms of service

These are the terms Pack and Fly, a business name of Gita N Nayna Pty Ltd (ABN 61 645 687 592) books travel under. They apply once you ask us to make a booking. Read them before you pay a deposit, because the cancellation terms in particular are easier to accept before you need them.
Our role
We act as an agent for the airlines, hotels, tour operators and other suppliers who actually provide your travel. We are not the provider of it. That means your contract for the travel itself is with those suppliers and is subject to their conditions of carriage or booking, which we will make available to you. Where a supplier fails to deliver, cancels, or becomes insolvent, our obligation is to help you pursue it, which we will do. Our own obligation to you is to arrange the booking with reasonable care and skill.
Quotes and prices
Airfares, room rates and tour prices are live and set by the supplier, so a quote holds only until the supplier changes the price or the availability. A quote is not a booking and does not hold a seat. Prices are quoted in Australian dollars and include the taxes and charges known at the time of quoting. If a supplier increases a price or adds a charge before your booking is ticketed or confirmed, we will tell you what it changed to and you can withdraw rather than accept it.
Booking, deposits and payment
A booking is confirmed only when the supplier confirms it and any deposit has been received, not when you tell us to go ahead. Deposit amounts, balance due dates and ticketing deadlines are set by the supplier and we will give them to you in writing before you pay. Missing a balance date can cancel a booking outright rather than simply delay it, and any deposit is then subject to the supplier cancellation terms.
How we are paid
We do not charge you a booking fee, a consultation fee or a fee for preparing a quote. We are paid a commission by the airlines, hotels, tour operators and other suppliers you book through. That commission forms part of the price the supplier sets and is not added on top of what you are quoted. We set out how it works on our pricing page. If a piece of work ever falls outside an ordinary booking, we will agree any charge with you in writing before starting it.
Changes and cancellations
Changes and cancellations are governed by the conditions of the fare or the product you bought, not by us, and many of the cheapest airfares cannot be changed or refunded at all. We will tell you those conditions before you book and we will tell you what a change will cost before we make it. Those charges are the supplier's, not ours.
Names, passports and visas
The name on your ticket has to match your passport exactly, and correcting it after ticketing can cost as much as a new fare or be impossible. Check every name, date of birth and passport number on the confirmation we send you and tell us straight away if anything is wrong. Passports, visas, transit permits, entry requirements and vaccination requirements are your responsibility. We will tell you what we understand the requirements to be and by when you need them, but requirements change and only the relevant government can tell you authoritatively. Check smartraveller.gov.au and the destination authority before you travel.
Travel insurance
We strongly recommend travel insurance, and we will ask whether you have it before you pay a deposit. We do not give personal advice about which policy suits you, so read the product disclosure statement and check the exclusions for pre-existing conditions, for the activities you have planned, and for whether the cancellation limit actually covers what your trip costs.
Our liability
Nothing in these terms excludes, restricts or modifies the consumer guarantees you have under the Australian Consumer Law, and if any term tried to, that term simply does not apply. Subject to those guarantees, we are not liable for the acts, omissions, delays, cancellations or insolvency of a supplier, or for events outside our reasonable control such as weather, strikes, border closures or airline schedule changes. Where we are liable for failing to arrange a booking with reasonable care and skill, our liability is limited to resupplying that service or paying the cost of having it resupplied.
Governing law
These terms are governed by the law of Western Australia, and the courts of Western Australia have jurisdiction.
